The Nicosia Administrative Court has ruled in favor of a patient who was initially denied access to medications under the General Health System (GESY) because their prescription was issued by a doctor not contracted with the Health Insurance Organisation (HIO).
The court determined that, according to the law, a prescription for necessary pharmaceuticals can be filled by a pharmacist contracted with the GESY, regardless of whether the prescribing doctor is a contracted staff or specialist physician. The court found that the Health Insurance Organisation had misinterpreted the law by requiring prescriptions to only come from contracted doctors, stressing that the law allows prescriptions from any medical practitioner, as long as they are filled by a GESY-contracted pharmacist.
This decision, which also included a €2,000 compensation for the applicant, is expected to ease pressure on the public healthcare system, allowing private doctors to issue prescriptions that can be filled at GESY pharmacies. The Cyprus Union of Private Medical Practitioners (ENIC) welcomed the ruling, urging for its immediate implementation to ensure patients' right to accessible healthcare and treatment.
